We believe that the “business-level” wisdom or flaws in most real estate transactions is solidified long before clients involve counsel. Even when clients involve counsel early on, the advice from many lawyers is overly focused on legal documents, rather than core business and operational issues. The reason is that most lawyers don’t actually understand their clients’ operations, much less how they will evolve over the course of time.
Our operational work results in genuine understanding of our clients workflow, raw materials and logistics, such that we consider whether sites will work today and in the future.
Once needs are fully defined, efforts turn to quarterbacking proactive communication with key stakeholders (including local officials, neighboring property owners and state-level economic development officials), solving problems discretely before they are raised in public view.
After the essential building blocks have been laid, the overtly legal can come into focus, from negotiating purchase agreements and leases to applications for zoning entitlements, PILOTs, governmental incentives and financing structures.
