The Decedent was a very well known businessman and community benefactor who was involved in a motor vehicle accident and became incapacitated and hospitalized. We made an application to have a guardian appointed for him, which he opposed with counsel. We prevailed and the court appointed a guardian for him. Extensive legal work was undertaken to coordinate his personal and business affairs. It was determined that although the decedent had undertaken some estate planning, no will or trust had ever come to be signed. We obtained a series of court orders which permitted the guardian and fiduciary to undertake and complete extensive financial and estate planning. The outcome remains that major gifts of a benevolent nature were made and completed in a manner consistent with the decedent’s intentions, despite that he died without a will.
