Our clients were fiduciaries seeking to obtain court approval for commissions in connection with a voluminous accounting relating to complicated ongoing businesses and a trust that evidenced an intent that they benefit based upon performance, with a non traditional method for calculating commissions. The court appointed a guardian ad litem for minors and we represented the trust and estate fiduciaries as special counsel.
The trust assets were well in excess of $50 million. Over $1.5 million of the commissions paid over a 15 year period to the trustees were questioned by the guardian ad litem. We legally briefed for the court the support of the payment of the substantial commissions and worked with the guardian ad litem to resolve the objections ending with a Decree of the court directing payment of the commissions in full.
