Our client was an institutional trustee for a special needs person, who benefitted from a medical negligence lawsuit settlement. The trustee filed an accounting covering several successive years. The court appointed a guardian ad litem who filed a mountain of objections ranging from violations of the prudent investor rule to improper investments and payments made by the trustee. We defended the trustee. The trust officer was examined under oath, as well as a case manager and an attorney. We settled the case for less than the cost to complete the defense.
